As a creative professional, you’ve likely experienced this scenario: after countless hours of work, you suddenly see your design used without your permission. Perhaps another company incorporates it into their marketing, or you find your creation printed on clothing in a shop. Such situations are both frustrating and emotionally draining. How do you prevent your creative ideas from being taken without consent?

Now, imagine another scenario: you unexpectedly receive a registered letter from a law firm demanding you stop using certain photos immediately. You had a great collaboration with a photographer and believed everything was settled. But now you discover that the photographer retained ownership of the photos, and your usage rights were limited to low-resolution online applications. This misunderstanding leads to a legal dispute, with no clear winners.

Proactively protecting your artwork

Here are some practical steps to safeguard your creative work:

  • Be proactive with contracts: always draft clear agreements that explicitly define ownership and usage rights. This applies to your own work as well as work outsourced to others, such as photographers or illustrators.
  • Use a watermark and metadata: consider adding a watermark to your digital work or embed metadata to assert ownership. This makes it more challenging for others to use your work without permission.
  • Register your work: consider officially registering your creations with a copyright office. This strengthens your legal position in the event of a dispute.
  • Use technology: use tools that automatically scan the internet for unauthorised use of your work. If you find infringements, you can take swift action.
