Training obligations within the labour deal

In November 2022, the new law on the ‘labour deal’ was published in the Belgian Official Gazette. The government introduced a comprehensive package of measures aimed at significantly increasing the employment rate by 2030. 

One of the key pillars of this package focuses on lifelong learning and the right to training. Until now, there was a collective right to training, calculated as an average number of training days per FTE across the company. This has now been transformed into an individual training right for every employee. 

Who is eligible? 

The individual training right applies only to private-sector companies with 10 or more employees: 

Companies with 10-19 employees are entitled to one paid training day per year. Companies with 20 or more employees must offer five individual training days (reduced to four training days in 2023). 

Companies with fewer than 10 employees are currently not eligible. 

Training obligations for your marketing team

Which courses? 

In addition to the individual training right, employers must provide a training plan which includes both formal and informal training each year. 

Formal training 

Formal training is delivered by a trainer or speaker and is developed by them. These courses are characterised by a high level of organisation from the trainer or training institution. They can be offered as part of an open programme (i.e., attended with participants from other organisations) or tailored specifically to suit the needs of your organisation. 

Informal training 

Informal training consists of training activities other than formal courses and is directly related to work. These activities are highly self-organised, with content determined by the individual needs of the workplace. They can be offered as part of an open programme (i.e., attended with participants from other organisations) or tailored specifically to suit the needs of your organisation. 

Training plan 

Besides the individual training right, companies with more than 20 employees will also be required to submit a training plan to the works council by 31 March. If your company does not have a works council, the plan should be submitted to union representation. If union representation is also not in place, the plan must be submitted directly to the employees.
